Lawsuits Alleging Fiduciary Breaches
Employee-participants continue to file lawsuits against self-insured health plan sponsors, alleging that the plan sponsor overpaid for covered medical and prescription drug benefits. These lawsuits also contend that the plan sponsor breached their fiduciary duties for failing to act prudently and monitor the plan’s service providers, and some lawsuits even go after employees of the plan sponsor serving as fiduciaries in their individual capacity. Plan sponsors are also filing lawsuits against the plan’s service providers for charging excessive fees and making overpayments to medical providers, and the DOL is claiming that certain service providers are fiduciaries. This panel discussion will provide you with up-to-date information on the details and status of these lawsuits.

Price Transparency – The Latest and Greatest
The Trump Administration is doubling down on requiring hospitals and health care payers to publicly disclose medical and prescription drug prices by improving and strengthening the existing Hospital Transparency and Transparency in Coverage (TiC) Rules. Proposed regulations would increase enforcement and penalties for non-compliance with both Rules. The proposed requirements would also streamline and standardize how prices are disclosed on the Machine-Readable Files (MRFs). Congress also supports strengthening and improving the existing price transparency rules and improving the disclosure of prescription drug prices and PBM payment practices. Being a Good Health Plan Fiduciary – What Does That Mean Now?
Plan sponsors have been put on notice that failure to examine and analyze health claims data, as well as the failure to discover things like hidden fees and overpayments, could expose them to fiduciary liability. As a result, plan sponsors are pushing back on those service providers that refuse to share a complete and accurate set of health claims data with the plan sponsor and the plan’s business associates. The Administration and Congress are trying to help plan sponsors in this endeavor by improving and strengthening the existing Gag Clause Prohibition and prohibiting owners of the provider networks from restricting the data and limiting the plan sponsor’s audit rights.
